What Michigan Law Says About Custody

Michigan’s Child Custody Act (MCL 722.23) requires courts to weigh 12 best-interest-of-the-child factors when making custody decisions. Those factors address emotional ties, each parent’s capacity to guide and support the child, and the stability of each home environment. None of the 12 factors reference the sex of either parent, so a mother’s position in a custody matter turns on the same considerations as any other parent’s.

Two additional statutes carry practical weight in most cases. MCL 722.27a provides that it’s generally in a child’s best interests to have a strong relationship with both parents, and parenting time is structured to support that. MCL 722.27 establishes the custodial environment doctrine: a court generally can’t change a custody arrangement that has been in place without clear and convincing evidence that the change serves the child’s best interests. These are general legal principles; how they apply depends on the facts of each case.
